These Terms of Use govern your use of the Whip website and its general features.

Whip is a UK automotive careers and recruitment platform operated as an unincorporated business.

By using the Whip website, you agree to these Terms of Use. If you do not agree with them, you should not use the website.

1. About Whip

Whip provides services designed to connect people with careers and employers across the UK automotive industry.

Whip's services currently include:

  • automotive job discovery and search;
  • links to vacancies advertised by employers and third-party recruitment websites;
  • candidate accounts and profiles;
  • Whip Talent;
  • employer accounts and Talent access; and
  • managed candidate introduction services.

Some Whip services may be subject to additional terms. In particular, candidates using Whip Talent and employers using Whip's recruitment or introduction services may be required to agree to separate terms governing those services.

2. Using the Whip website

You may use Whip only for lawful purposes.

You must not:

  • misuse, interfere with or attempt to compromise the website or its security;
  • attempt to gain unauthorised access to accounts, candidate information or restricted areas;
  • scrape, harvest, copy or systematically extract candidate profiles or other Whip data without permission;
  • use automated systems to access Whip in a way that places unreasonable demands on the service;
  • impersonate another person or organisation;
  • knowingly provide false, misleading or fraudulent information;
  • upload malicious software or harmful material;
  • use Whip to send spam, unsolicited marketing or abusive communications; or
  • use information obtained through Whip for an unlawful or unauthorised purpose.

Whip may restrict or suspend access where reasonably necessary to protect users, candidates, employers, the platform or its security.

3. Job listings

Whip displays automotive job vacancies from employers and other recruitment sources.

Whip aims to provide useful and current vacancy information, but vacancies can change, expire or be withdrawn by an employer without notice.

Unless expressly stated otherwise, displaying a vacancy on Whip does not mean that Whip is the employer.

Applications for jobs currently displayed on Whip are completed through the relevant employer or external recruitment website. Whip does not currently receive applications submitted through those external websites.

Users should review the information provided by the relevant employer before applying.

Where Whip becomes aware that information displayed on the website is materially inaccurate or no longer current, Whip may correct or remove it.

4. External websites

Whip contains links to websites operated by employers and other third parties.

These websites are outside Whip's control and may have their own terms, privacy policies and practices.

A link from Whip does not mean that Whip controls or accepts responsibility for the third-party website.

You should review the relevant third party's terms and privacy information when leaving Whip.

5. Candidate accounts and Whip Talent

Whip Talent is intended for people aged 18 or over.

Candidates are responsible for ensuring that information they provide is accurate and reasonably current.

Candidate accounts are personal and should not be shared with another person.

Whip may provide approved employers with access to selected professional information from candidates who have chosen to be discoverable through Whip Talent.

Private contact details and CVs are not made generally available to employers browsing Whip Talent.

Use of Whip Talent's work-finding and managed introduction services will also be subject to separate Candidate / Whip Talent Terms, which candidates will be asked to agree to before Whip provides those services.

6. Employer accounts and Talent access

Whip Talent is not an unrestricted public candidate database.

Whip may review and approve employers before granting access to candidate profiles.

Employer users must:

  • represent a genuine organisation or recruitment requirement;
  • provide accurate account and organisation information;
  • keep login credentials secure;
  • use candidate information only for legitimate recruitment purposes;
  • respect the confidentiality of candidate information; and
  • comply with applicable employment, equality and data-protection law.

Whip may refuse, suspend or withdraw employer Talent access where reasonably necessary to protect candidates or the platform, or where these Terms are breached.

Use of Whip's employer recruitment and candidate-introduction services may also be subject to separate Employer Terms of Business.

7. Candidate introductions

An employer's request for an introduction does not give that employer automatic access to a candidate's private contact information or CV.

Whip will contact the candidate and the candidate decides whether they wish to proceed with the proposed introduction.

Whip will only facilitate the introduction where the candidate agrees.

A candidate's CV will only be shared with an employer where the candidate has specifically agreed to that sharing.

Further terms governing Whip's work-finding service will be set out in the Candidate / Whip Talent Terms.

8. No candidate work-finding fee

Whip does not charge candidates a fee for finding them employment or for introducing them to a prospective employer.

Any optional paid service Whip might introduce in future that is legally permitted and separate from work-finding would be clearly identified and governed by separate terms.

UK rules generally prohibit employment agencies from charging work-seekers for work-finding services.

9. Accounts and security

You are responsible for keeping your account credentials confidential and for activity carried out through your account.

You should notify Whip promptly if you believe your account has been accessed without permission.

Whip may require password resets, restrict access or take other reasonable security measures where an account may have been compromised.

10. Availability of Whip

Whip aims to keep its services available and functioning reliably, but continuous or uninterrupted availability cannot be guaranteed.

Whip may change, suspend or temporarily withdraw parts of the website for maintenance, security, technical, legal or operational reasons.

Whip may also introduce, change or discontinue features as the platform develops.

11. Information and employment decisions

Whip helps candidates and employers discover and connect with one another.

Whip does not guarantee that:

  • a candidate will receive an interview or job offer;
  • an employer will find or hire a suitable candidate;
  • any particular vacancy will remain available;
  • an introduction will result in employment; or
  • information supplied by an independent candidate, employer or third party will always be complete or error-free.

Employers remain responsible for their recruitment decisions and for carrying out appropriate checks before employing someone.

Candidates remain responsible for deciding whether a role and employer are suitable for them.

Where Whip provides a managed introduction service, Whip will comply with the applicable requirements governing that service.

12. Intellectual property

Unless otherwise stated, the Whip name, branding, website design, original written content, software and other material created by Whip are owned by or licensed to Whip.

You may use the website for your own legitimate job-search, recruitment or informational purposes.

You must not reproduce, sell, republish or commercially exploit substantial parts of Whip's content, database or platform without permission, except where permitted by law.

Employer names, logos, trademarks and third-party content remain the property of their respective owners.

13. Privacy

Personal information is handled in accordance with Whip's Privacy Policy.

Whip's Privacy Policy explains what information is collected, how it is used, candidate visibility controls, retention and your data-protection rights.

14. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation or for death or personal injury caused by negligence where applicable.

Subject to those rights and applicable law, Whip is not responsible for losses caused solely by matters outside Whip's reasonable control, or for the independent acts, omissions or decisions of employers or third-party websites.

Nothing in these Terms affects any legal rights that cannot lawfully be excluded.

15. Changes to these Terms

Whip may update these Terms as the platform, services or legal requirements change.

The latest version will be published on the Whip website with an updated Last updated date.

Where a material change affects a registered service subject to acceptance of additional terms, Whip may require users to accept updated terms before continuing to use that service.

16. Governing law

These Terms are governed by the laws of England and Wales.

Any dispute will be subject to the jurisdiction applicable under UK law, including any mandatory rights you may have regarding where proceedings can be brought.
